Recovery of Funds
In the event of a debit balance in the Client’s account owing to the acceptance of a bet more than the credit or deposit limit, the Client shall, within three (3) business days of a written demand by Your Bet for payment of same, pay to Your Bet such amount either –
- by depositing the relevant amount directly into the banking account of Your Bet, in which event –
- the Client’s account number with Your Bet must be entered onto the base of the deposit slip; and
- a copy of the deposit slip must be forwarded to Your Bet by the Client, or
- by furnishing Your Bet with written permission, in such format as Your Bet shall require, for the recovery by Your Bet of the relevant amount from the Client’s credit card company.
Your Bet shall not –
- under any circumstances whatsoever be liable to the Client if the Client’s credit card company refuses to honor any claim lodged by Your Bet against the Client’s credit card. No dispute of whatever nature between a Client and the credit card company shall exempt the Client from his liability to Your Bet in respect of payment and the Client shall not be entitled to instruct Your Bet to reverse a payment instruction that has already been made to the Client’s Credit Card company;
be responsible for –
- any failure, malfunction or delay of any electronic funds transfer unit or other credit card processing machine or its supporting or sharing network, resulting from circumstances beyond the control of Your Bet, or
- any damages, loss, or expense which the Client may suffer as a result thereof, and
Under any circumstances be liable for any loss or damage suffered by the Client because of the unauthorised access to any data or as a result of incorrect information supplied through an electronic funds transfer unit or other credit card processing machine or its supporting or sharing network.
Your Bet shall be entitled to recover amounts from the Clients in any of the following circumstances, (but without limitation to same):
- if there is a debit balance in the Client’s Account owing to the incorrect acceptance of a bet in excess of limit reflected in the Client’s account;
- if Your Bet has in error credited a Client’s account through incorrect bet settlement and the Client has spent all or part of the erroneously credited amount;
- if Your Bet has incorrectly allocated funds to a Client’s account and the Client has spent all or part of the incorrectly allocated amount; or
- if the Client has placed a bet in contravention of the Terms, and such bet is subsequently adjusted so that the Client has spent all or part of the adjusted balance, resulting in a negative account balance.
Your Bet may at its sole discretion from time to time determine the way payments by the Client to Your Bet shall be appropriated in respect of amounts owing by the Client to Your Bet.
Should any bets be placed with monies mistakenly credited to the Client’s account, Your Bet reserves the right to void such bets and shall not be held liable for any losses sustained by the Client in consequence thereof.
Notwithstanding anything to the contrary herein contained, Your Bet shall be entitled to set-off any amount(s) due to Your Bet by the Client against any funds standing to the credit of the Client’s betting account or to realize any security held by Your Bet and to use the proceeds towards payment of any amount due and payable by the Client to Your Bet.
