Termination
Your Bet reserves the right, before accepting any bet, to temporarily suspend or permanently terminate the furnishing of betting services to a Client without providing a reason.
Upon such suspension or termination:
- Your Bet shall, upon the demand of the Client, refund to the Client the balance of any monies held by Your Bet on deposit for the Client, after adjusting for losses, winnings, and taxes, and within seven (7) business days of such funds being cleared into Your Bet banking account.
- Any amounts owing by the Client to Your Bet shall become payable immediately.
The Client shall, upon providing written notice to Your Bet, be entitled to terminate their contractual relationship with Your Bet at any time after the conclusion of any pending betting transactions and after payment of all amounts owed by the Client to Your Bet. Your Bet shall, within a reasonable time (not exceeding seven (7) business days) after such termination, refund to the Client the balance of any monies held on deposit, after adjusting for losses, winnings, and taxes.
Your Bet shall accept no further bets from a Client whose provision of services under these Terms has been terminated unless and until a new account application form is submitted by the Client and accepted by Your Bet.
Your Bet shall be entitled, without prejudice to any other rights it may have at law, to immediately terminate its contractual relationship with the Client, terminate or suspend any bet placed by such Client (whether accepted or not), and/or claim damages from the Client.
In such an event:
- All amounts owed by the Client to Your Bet shall become payable immediately.
- Your Bet shall have a lien and right of retention over all monies held by Your Bet on deposit for the Client, pending the settlement of any damages suffered by Your Bet.
Notwithstanding the generality of the foregoing, the Client shall be deemed to be in default if:
- The Client commits any act of insolvency.
- The estate of the Client is sequestrated or any similar event occurs under applicable law.
- The Client attempts to compromise generally with their creditors.
- The Client’s name is entered into the register of excluded persons contemplated in section 14 of the National Gambling Act, 2004.
The Client shall be liable for any reasonable legal expenses (on the attorney-client scale, including collection charges and tracing fees) as well as any government taxes, including but not limited to value-added tax, which Your Bet incurs in recovering any amounts owed in respect of the Client’s account or as a result of the Client’s breach of these Terms or the enforcement by Your Bet of any of its rights against the Client.
